This English version is a translation provided for convenience; if there is any conflict, the Spanish version controls.
1. Who we are
The Postcard Studio ("the Studio") is operated by The Postcard Studio, S.A., NIT 120976978, based in Guatemala. Contact: thepostcardstudiogt@gmail.com and WhatsApp +502 5500 5134. By using www.thepostcardstudio.co, our social media, or buying any product or service, you accept these Terms, our Privacy Policy and our Refund Policy.
2. What we sell
Ready-made products: postcards, prints and stationery already designed.
Custom orders: pieces created or adapted at the customer's request, including texts, names, photos or designs provided by the customer.
Events and workshops: in-person or online experiences with a set date, time and capacity.
3. Eligibility and accounts
You must be at least 18 years old or have permission from a parent or guardian to buy. You are responsible for the accuracy of your information and for keeping your account secure.
4. Prices and payment
Prices are shown in Guatemalan quetzales (GTQ), US dollars (USD) or euros (EUR) and include VAT where applicable. They do not include shipping, customs duties, import taxes, or bank or currency conversion fees in the destination country, which are paid by the buyer. Payments are processed by Tilopay; we do not store full card details. We may correct obvious pricing or inventory errors and cancel the affected order with a full refund. An order is confirmed only once we receive full payment, or the deposit for custom orders.
5. Custom orders
a) Custom orders require a non-refundable 50% deposit to begin design work. The balance is due before delivery or shipping.
b) We will send a digital proof. You are responsible for checking spelling, names, dates, colors and design. Once you approve the proof, we are not responsible for errors contained in it.
c) Each order includes up to 2 rounds of changes; additional changes may be charged.
d) If we receive no response within 30 days of sending the proof, the order is considered abandoned and the deposit is not returned.
e) By sending us photos, texts, logos or other material, you confirm you have the right to use them and you release us from any third-party claims over that material. We may refuse content that is offensive, illegal, defamatory or infringes third-party rights.
6. Colors and handmade nature
Colors may vary between screen and print, and between batches of paper or ink. Handmade pieces may show small variations. These differences are not defects.
7. Local and international shipping
Delivery times are estimates and depend on the courier and customs. The buyer must provide a complete and correct address; reshipping due to an incorrect address will be charged. For shipments outside the European Union, and to the extent permitted by law, risk of loss passes to the buyer when the package is handed to the carrier. We offer tracked and insured shipping when available; if the buyer chooses untracked shipping, the Studio is not responsible for losses. Packages held or returned by customs for unpaid duties are refunded only for the value of the products, minus shipping and return costs.
8. Events and workshops
Spots are limited and confirmed upon payment. Cancellations are governed by our Refund Policy. Participants must follow the facilitator's instructions and use materials and tools with care; minors attend under the responsibility of their parent or guardian. We may refuse entry, without refund, to anyone whose behavior puts others or the space at risk. Participants are responsible for damage they cause to equipment or facilities.
9. Photos and video at events
We take photos and videos at events and workshops that we may publish on our social media and website. By registering, you authorize this use without compensation. If you do not want to appear, tell us at the start of the event or email thepostcardstudiogt@gmail.com and we will remove content where you are identifiable. We do not publish the faces of minors without permission from their parent or guardian.
10. Intellectual property
All designs, illustrations, photos, texts, trademarks and workshop materials belong to the Studio or its licensors. Buying a product grants personal, non-commercial use only. You may not reproduce, scan, resell, print on other products, or use our designs to train artificial intelligence tools without written permission. For custom orders, the customer keeps the rights to their own material and the Studio keeps the rights to its design, style and source files, and may show the finished piece in its portfolio unless the customer requests confidentiality in writing before approving the proof.
11. User content
If you tag us or share content related to our products, you authorize us to reshare it on our social media with credit to your account. You may ask us to remove it at any time.
12. Chargebacks
Before opening a chargeback, contact us so we can resolve the issue. A chargeback opened without contacting us, or for an order delivered in accordance with these Terms, will be disputed with the order records and may result in suspension of future purchases.
13. Limitation of liability
To the maximum extent permitted by law, the Studio's total liability for any claim is limited to the amount paid for the product or service in question. We are not liable for indirect damages, lost profits, carrier or customs delays, or failures of third-party services. Nothing in these Terms limits consumer rights that cannot be waived by law.
14. Force majeure
We are not responsible for failures caused by events beyond our control, such as natural disasters, weather events, power outages, unrest, strikes, pandemics, government restrictions or carrier failures. In those cases we may reschedule or, if that is not possible, offer credit or a refund.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Guatemala. Any dispute will be submitted to the competent courts of Guatemala City, without prejudice to the non-waivable rights that the law of a consumer's country of residence grants them. Before going to court, the parties will try in good faith to resolve the dispute for 30 days.
16. Changes
We may modify these Terms at any time. The version that applies to each purchase is the one in effect on the order date.
17. Severability
If any clause is found invalid, it will be limited to the minimum extent necessary and the rest will remain in effect.
